Trademark Registration Invalidated Due to Non-Use | LSA

The registration of the “Zanga” trademark has been declared invalid due to non-use

Our client intended to use the trademark “Zanga” in the course of business activities; however, it was discovered that the trademark “Zanga” had already been registered and belonged to another party.

Following the client’s request, we began identifying possible legal solutions within the framework of intellectual property regulation. As a result of the legal analysis and review conducted by attorney Nahapet Sukiashyan of our office, it was established that the trademark “Zanga” had been registered in the name of another person for 5 years, but had not been actually used during the last 3 years.

Based on the above, an application was submitted to the Intellectual Property Agency requesting registration of the “Zanga” trademark in the name of our client. Subsequently, a lawsuit was filed with the Court of General Jurisdiction of Yerevan seeking to invalidate the registration of the “Zanga” trademark registered in the name of another party.

During the court proceedings, we presented and substantiated the client’s legal interest in the cancellation of the trademark registration, as well as evidence confirming the non-use of the trademark.

By the decision of the Court of General Jurisdiction of Yerevan in civil case No. ED2/12486/02/25 (see  https://datalex.am:443/?app=AppCaseSearch&case_id=49258120924439453)) dated June 4, 2026, the claim was fully satisfied, and it was decided to cancel the legal protection of the trademark “ZANGA ZANGA ZANGA”, registered under No. 30263, in the Republic of Armenia with respect to all goods for which it had been registered.

This judgment is of significant importance for the development of intellectual property protection practice and the legal framework regarding non-used trademarks.
