After Losing in the Court of First Instance in a Claim for Recovery of More Than AMD 8,500,000, the Claimant Applied to “LSA” Law Firm and Achieved Success in the Civil Court of Appeal

In civil case No. ED/57083/02/21, examined by the Court of General Jurisdiction of First Instance of Yerevan, the court of first instance had upheld the claim filed against our client and recognized the claimant as an heir who had accepted the inheritance on the basis of factual possession, thereby declaring invalid the state registration of ¾ of our client A.B.’s ownership right. The court had also dismissed our counterclaim seeking the eviction of the unlawful possessor(s) of the apartment.

A resident of Kotayk Province had filed a lawsuit against our client, E.T., demanding recognition of ownership based on acquisitive prescription. Our office’s attorney, Edgar Ayvazyan, who represents E.T., filed a counterclaim requesting the eviction of the individuals who had unlawfully seized our client’s land plot.

The Prosecutor General’s Office of the Republic of Armenia had filed a lawsuit against our client, seeking to declare the 2012 auction invalid and to apply the consequences of invalidity (civil case No. HKD/0174/02/25).

In the judicial practice of the Republic of Armenia, a stable approach has gradually developed regarding the provision of compensation to individuals acquitted in criminal proceedings. Nearly four years ago, our client A.Gh., who was acquitted, had been held in detention for 677 days; in addition, a search had been conducted at his home.

The Lori Regional Court, in case No. LD/6898/02/23, partially rejected the insurance company’s claim and issued a judicial act that met the expectations of our client, Vanik Zalinian.
