The Prosecutor’s Office once again reaffirmed that sealing the doors of a legal entity’s place of business during a search and thereby effectively suspending its operations is unlawful.

In another criminal proceeding, the investigative body conducted a search at the place of business of a legal entity and, at the end of the search, sealed the premises, effectively prohibiting its operation.
The complaint filed against the investigator’s actions was upheld by the supervising prosecutor’s decision dated October 6, 2025, and the investigator’s actions were recognized as illegal.

In the decision to grant the complaint, the prosecutor recorded that the investigator’s actions violated the rights of the economic entity guaranteed by Article 60 of the Constitution of the Republic of Armenia and Article 1 of Protocol No. 1 to the European Convention on Human Rights.

We believe that this approach, which has long been considered problematic, will finally be brought into the legal field and properly regulated within the framework of prosecutorial oversight of pre-trial criminal proceedings.
